Terms of Service

Scan Your Space provides 3D virtual tours, 360° photography, LiDAR scanning, site surveys, BIM-ready scanning, HDR and aerial photography, and camera rentals across Northern California. Specific deliverables, scope, and timing are defined in the quote or order for each project.

• Our pricing is published and flat-rate, with a $240 project minimum. Square-footage rates, add-ons, and travel beyond 30 miles ($0.70/mile round trip) are described on our pricing page.
• Written quotes are valid for 30 days unless stated otherwise.
• Unless agreed otherwise, project fees are invoiced on delivery and due on the terms stated on the invoice. Recurring and enterprise clients may arrange separate billing terms.
• Late or unpaid balances may incur reasonable late fees and may pause hosting or delivery.

You are responsible for providing safe, timely access to the spaces to be scanned and for staging them as you want them shown. If we cannot access or complete a scheduled scan due to factors outside our control, a trip or rescheduling fee may apply. Please provide as much notice as possible to cancel or reschedule.

• Rentals require a refundable damage deposit and proof of insurance or an optional damage waiver, confirmed before pickup or shipment.
• You are responsible for the equipment during the rental term and for returning it on time and in the condition received, normal wear excepted.
• You are liable for loss, theft, or damage beyond any waiver coverage, and late returns may incur additional daily charges.
• Booking and payment for rentals may be handled through a third-party processor.

• Upon full payment, you receive a license to use the delivered tours, images, floor plans, and data for your business and marketing.
• Until payment is received in full, Scan Your Space retains all rights in the work product.
• Tour hosting is included for 24 months; renewal or export options apply thereafter.
• We may display non-confidential project work in our portfolio and marketing unless you request otherwise in writing.

You represent that you have the right and authority to have the relevant spaces scanned and to grant access. You are responsible for removing or concealing confidential, proprietary, or protected information (including any protected health information) before capture. You will not ask us to capture content that infringes the rights of others or violates applicable law.

You agree not to misuse the website, including attempting to disrupt it, access it without authorization, scrape it at scale, or use it for unlawful purposes. Website content is owned by Scan Your Space / Sparks Media Group and may not be copied or reused without permission.

Our website and services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee specific business outcomes such as bookings, leads, search rankings, or sales resulting from our work.

To the maximum extent permitted by law, Scan Your Space and Sparks Media Group will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits. Our total liability for any claim arising out of a project will not exceed the amount you paid for that project.

You agree to indemnify and hold harmless Scan Your Space, Sparks Media Group, and their personnel from claims arising out of your breach of these Terms, your content, or your failure to obtain necessary permissions or rights for the spaces and materials we capture.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Solano County, California, and you consent to their jurisdiction.

We may update these Terms from time to time. We will revise the “Last updated” date above, and continued use of the site or services after changes means you accept the updated Terms.
